Terms and Conditions

 

1.Applicability

1.1 GREENTIX is a technical service provider of an automated CO2 compensation program and (digital and physical) CarbonCards (hereinafter "Service"). GREENTIX is located at the address: Stieltjesstraat 114, 3071 JX Rotterdam.
1.2 These Terms and Conditions apply to all users of greentix.org and the login environment and natural or legal persons who purchase or use CarbonCards.
1.3 These Terms and Conditions apply to any use of the compensation program and the login environment, and to the purchase and use of CarbonCards. By using the compensation program, the login environment or purchasing or using CarbonCards, you agree to these Terms.

2. Definitions

The following terms are capitalized in the Terms:

• CarbonCard: The physical and/or digital voucher for GREENTIX, issued by greentix.org;
• Holder: A natural person or legal entity in possession of or with access to a CarbonCard;
• IP Rights: All intellectual property and related rights, such as copyrights, trademark rights, patent rights, design rights and trade name rights;
• Trademark: The in the trademark register of the Benelux Office for Intellectual Property in the name of GREENTIX;
• Customer: A legal or natural person who uses greentix.org, the login environment, who purchases or uses one or more CarbonCard(s);
• Balance: The current balance on a CarbonCard, ie a claim of the Holder on GREENTIX;
• Confidential Information: All data, information and data in any form whatsoever that GREENTIX provides to Customer and which Customer provides to GREENTIX, and which have been designated by GREENTIX as confidential or of which the Customer can reasonably suspect the confidentiality.

3. Intellectual Property

3.1 The intellectual property rights to the content contributed by GREENTIX, the CarbonCard and greentix.org (concept, logo, brand, packaging, etc.) or other documents belong to GREENTIX or its licensors.
3.2 GREENTIX reserves the right to modify the Service at any time and without prior notice (including design, operation and functionalities).

4. Carbon Cards

4.1 General
4.1.1 The CarbonCard can be ordered with a credit of 140, 420, 840 or 1820 GreenTix.
4.1.2 The CarbonCard is not rechargeable.
4.1.3 The CarbonCard cannot be claimed in phases.
4.1.4 The CarbonCard can only be used to redeem GreenTix on the GREENTIX platform.
4.1.5 The CarbonCard is valid for one year from the date of issue.
4.1.6 CarbonCards are only intended for purchase by natural persons, not acting on behalf of a company.
4.2 Payments and Payouts
4.2.1 GREENTIX will charge an amount for each CarbonCard sold as a donation for the GreenTix, an amount for administration costs and, in the case of a physical CarbonCard, an amount for shipping and handling.
4.3 Intellectual Property
4.3.1 All IP Rights of the CarbonCard and greentix.org (concept, logo, brand, packaging, etc.) belong to GREENTIX or its licensors.
4.3.2 Customers are not permitted to make changes or additions to the CarbonCard and/or packaging.

5. Shipping

5.1 Ordered digital CarbonCards will be sent by email within one business day.
5.2 Ordered physical CarbonCards are presented to the delivery service within 5 working days. The delivery service will try to realize delivery within two working days.

6. Returns and cancellation

6.1 The purchase of purchased digital CarbonCards can be canceled within two weeks, provided the GreenTix has not been redeemed. For this you can send the email with the voucher code to info@GreenTix.org. We will invalidate the code and will refund the purchase amount within two weeks.
6.2 In the case of ordered physical CarbonCards, the purchase can be canceled by returning the CarbonCards to us within two weeks of receipt, provided the voucher codes have not been redeemed. We will transfer the purchase amount to the orderer within two weeks of receipt of the return. We do not reimburse shipping and handling costs in that case.

7. Final Provisions

7.1 Provisions from these Terms and Conditions do not apply insofar as they conflict with applicable provisions of mandatory law. Should any provision in these Terms be void or otherwise unenforceable, that will not affect the validity of the remaining provisions in these Terms. In such a case, the Parties will negotiate in good faith about the amendment of the relevant provisions in such a way that it is enforceable and does as much justice as possible to the intentions of the Parties with regard to the relevant provision.
7.2 These Terms and Conditions are governed by Dutch law. All disputes arising out of or in connection with these Terms will be submitted to the competent court.
